Welcome to PAR EXCELLENCE.
The terms “we,” “us,” and “our” refer to PAR EXCELLENCE. We operate this online store and website, including its content, features, products, and related services (collectively, the “Services”).
Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer our products to you.
These Terms of Service (“Terms”) explain your rights and responsibilities when accessing our website or purchasing from our store. By visiting our website, submitting an order, or otherwise using the Services, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, please do not use the Services.
1. Eligibility and Account Information
You must be at least the age of majority in your state of residence to make a purchase through the Services. If a minor uses the Services, a parent or legal guardian must supervise and authorize that use.
You agree to provide accurate, current, and complete billing, payment, shipping, and contact information.
If you create an account, you are responsible for protecting your login credentials and for activity conducted through your account. Please notify us promptly if you believe your account has been accessed without authorization.
2. Handcrafted Products
PAR EXCELLENCE products are handcrafted in small batches. Natural variations in color, shape, texture, pattern, scent, weight, or appearance may occur from one batch to another. These variations are part of the handmade nature of our products and do not necessarily indicate a defect.
We make reasonable efforts to display product colors and images accurately. However, colors and appearance may differ depending on your device, screen settings, lighting, and the natural characteristics of each batch.
Product descriptions, photographs, prices, ingredients, availability, and other information may be updated without prior notice. We may discontinue a product or limit the quantity available for purchase at any time.
3. Personal-Care Product Information
Our soaps, lotions, and skincare products are intended for external cosmetic use only unless a product label specifically states otherwise.
Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Product descriptions and other information provided through the Services are for general informational purposes and are not medical advice.
Individual reactions to personal-care products can vary. Customers should review the product’s ingredient information before use and avoid any product containing a known allergen or ingredient sensitivity.
We recommend performing a small patch test before using a new product. Discontinue use if irritation or discomfort occurs. Avoid contact with the eyes and follow all warnings and directions provided on the product label.
If you are pregnant, nursing, under medical care, have a medical condition, or have concerns about an ingredient, consult a qualified healthcare professional before use.
4. Orders and Order Acceptance
Submitting an order is an offer to purchase products from PAR EXCELLENCE. An automated order confirmation acknowledges that we received your order but does not guarantee final acceptance.
We reserve the right to refuse, limit, modify, or cancel an order when reasonably necessary, including because of:
- Product unavailability
- Incorrect pricing or product information
- Suspected fraud or unauthorized activity
- Payment-processing problems
- Shipping restrictions
- Errors affecting the order
- Violation of these Terms
If we cancel an order after payment has been processed, we will issue a refund to the original payment method for the canceled portion.
Please review your order and shipping address carefully before submitting it. We cannot guarantee that changes or cancellations can be made after processing begins.
Products purchased through our retail store are intended for personal or household use and may not be purchased for unauthorized commercial resale.
5. Prices, Taxes, and Payment
Prices and promotions may change without notice. The price charged will be the price displayed when you submit your order, subject to correction of clear errors.
Unless otherwise stated, displayed prices do not include shipping charges or applicable taxes. Any required charges will be shown during checkout before you complete your purchase.
You agree to provide accurate and authorized payment information. By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment providers to process the applicable charges.
Discount codes and promotions may have separate conditions, expiration dates, exclusions, or quantity limits. Unless expressly permitted, promotions cannot be combined or applied retroactively.
6. Shipping and Delivery
Orders are currently shipped within the United States unless otherwise stated during checkout.
Our estimated order-processing time is 2–5 business days. Estimated standard U.S. delivery after shipment is generally 3–7 business days.
Processing and delivery times are estimates and are not guaranteed. Delays may occur because of weather, holidays, carrier operations, high order volume, incorrect address information, or other circumstances outside our reasonable control.
Tracking information will be provided when available. Tracking may take up to 24 hours to update after a shipping label is created.
Customers are responsible for providing a complete and accurate shipping address. If you discover an address error, contact us immediately at support@parexcellenceskincare.com . We will try to update the address before shipment, but changes cannot be guaranteed once an order has entered processing or has shipped.
Additional shipping terms are provided in our Shipping Policy, which is incorporated into these Terms.
7. Returns, Refunds, and Damaged Orders
Return requests for eligible products must be made within 30 days of delivery.
Because soaps, lotions, and skincare products are personal-care items, opened or used products cannot be returned for hygiene and safety reasons. Eligible products must be unused, unopened, in their original packaging, and accompanied by proof of purchase.
Damaged, defective, or incorrect orders must be reported within 48 hours of delivery. Please include your order number and clear photographs of the package and affected product.
We do not currently offer direct exchanges. If a return is approved, you may place a separate order for another product.
All returns and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms.
Nothing in these Terms limits any rights that cannot legally be limited under applicable consumer-protection law.
8. Accuracy of Information
We make reasonable efforts to provide accurate information, but the Services may occasionally contain typographical errors, inaccuracies, or omissions involving product descriptions, ingredients, pricing, promotions, shipping charges, availability, or delivery estimates.
We may correct errors and update information when discovered. If an error materially affects an order you have already submitted, we may contact you for instructions or cancel the affected portion and issue an appropriate refund.
9. Intellectual Property
The Services and their original content—including our business name, product names, logos, photographs, graphics, designs, written content, videos, and website arrangement—are owned by PAR EXCELLENCE or used with permission and are protected by applicable intellectual-property laws.
You may access the Services for personal, noncommercial use. Without our prior written permission, you may not reproduce, distribute, sell, modify, republish, publicly display, or commercially exploit our protected content.
Shopify and any other third-party names, trademarks, and logos appearing through the Services belong to their respective owners.
10. Reviews and Feedback
If you voluntarily submit a product review, photograph, suggestion, comment, or other feedback, you grant PAR EXCELLENCE a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and share that material for operating and promoting our business, subject to applicable law.
You represent that you own or have permission to submit the material and that it does not violate another person’s intellectual-property, privacy, or other legal rights.
Reviews must reflect genuine experiences. You may not submit content that is knowingly false, misleading, unlawful, threatening, abusive, discriminatory, obscene, defamatory, or harmful.
We may remove content that violates these Terms or applicable law.
11. Prohibited Uses
You may not use the Services:
- For an unlawful, fraudulent, or malicious purpose
- To violate applicable laws or regulations
- To infringe our rights or the rights of another person
- To submit false, deceptive, abusive, or harmful information
- To distribute malware, viruses, spam, or unauthorized solicitations
- To interfere with the security or operation of the Services
- To collect another person’s information without authorization
- To impersonate another person or entity
- To attempt unauthorized access to accounts, systems, or data
- To scrape, copy, or commercially exploit the Services without permission
We may restrict or terminate access when we reasonably believe these Terms have been violated.
12. Third-Party Services and Links
The Services may include links to or features provided by third parties, including payment processors, shipping carriers, social-media platforms, and other service providers.
We do not control third-party websites or services and are not responsible for their content, availability, security, or practices. Your use of a third-party service may be governed by that provider’s separate terms and privacy policy.
13. Relationship With Shopify
PAR EXCELLENCE uses Shopify to host and operate its online store. Purchases from our store are transactions directly between you and PAR EXCELLENCE.
Shopify is not the seller of our products and is not responsible for the manufacture, description, fulfillment, delivery, safety, or use of products purchased from PAR EXCELLENCE.
Shopify may process information as described in our Privacy Policy and Shopify’s applicable privacy notices.
14. Privacy
Our collection and use of personal information are governed by our Privacy Policy.
By using the Services, you acknowledge that information may be processed by Shopify, payment providers, shipping providers, and other service providers needed to operate our store and fulfill orders.
15. Availability of the Services
We do not guarantee that the website or Services will always be available, uninterrupted, secure, or error-free.
We may modify, suspend, or discontinue all or part of the Services when reasonably necessary. We are not responsible for interruptions caused by maintenance, internet failures, third-party services, security incidents, or circumstances outside our reasonable control.
16. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.
Except for warranties that cannot legally be excluded, PAR EXCELLENCE disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that every product will produce the same experience or result for every customer. Natural ingredients, skin types, sensitivities, storage conditions, and individual use can affect a customer’s experience.
This section does not exclude any warranty or consumer right that cannot legally be waived.
17. Limitation of Liability
To the fullest extent permitted by law, PAR EXCELLENCE and its owners, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the Services or products purchased through the Services.
Where liability cannot be excluded, our liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability when doing so would be unlawful, including liability that cannot be excluded under applicable consumer-protection law.
18. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless PAR EXCELLENCE and its owners, employees, contractors, and service providers from third-party claims, losses, or reasonable expenses arising from:
- Your unlawful or unauthorized use of the Services
- Your material violation of these Terms
- Your infringement of another person’s rights
- Content you submit through the Services
This provision does not apply to claims caused by PAR EXCELLENCE’s own unlawful conduct, gross negligence, or willful misconduct.
19. Termination
You may stop using the Services at any time.
We may suspend or terminate access to the Services if you materially violate these Terms, engage in unlawful or fraudulent activity, threaten the security or operation of the Services, or fail to pay amounts properly due.
Terms that logically should remain effective after termination—including intellectual-property, payment, warranty, liability, indemnification, and governing-law provisions—will survive termination.
20. Severability
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the greatest extent permitted by law or severed if necessary. The remaining provisions will continue in effect.
21. No Waiver
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision later.
22. Entire Agreement
These Terms and the policies incorporated by reference constitute the entire agreement between you and PAR EXCELLENCE concerning your use of the Services.
If a specific promotion or written agreement contains terms that conflict with these Terms, the more specific terms will control for that promotion or agreement.
23. Assignment
You may not transfer your rights or obligations under these Terms without our written consent.
We may transfer our rights and obligations in connection with a merger, sale, reorganization, transfer of the business, or use of a successor service provider, subject to applicable law.
24. Governing Law
These Terms are governed by the laws of the State of Mississippi and the applicable federal laws of the United States, without regard to conflict-of-law principles.
Any dispute that is not otherwise resolved will be handled by a court with lawful jurisdiction in Mississippi, except where applicable law gives you the right to bring a claim in another location.
25. Changes to These Terms
We may update these Terms periodically to reflect changes in our business, Services, policies, or legal obligations.
The updated version will be posted on this page with a revised “Last Updated” date. Material changes will be communicated when required by applicable law.
Your continued use of the Services after updated Terms become effective constitutes acceptance of those changes.
